Letter from DOJ, ATF regarding new forms for sales of weapons to Illegals

Regardless of the inconveniences imposed on responsible FFL Weapons Dealers and this sorry sack of scum bags colluded in whatever scheme they've got going on to, as we NOW know is either 1. For Political Gain and Power Grabs 2. To get themselves out of trouble no matter how guilty they obviously are, how much the evidence proves it, at any cost.

There are no other reasons for this administration, the DOJ, the Department of Jokers, to do ANYTHING in their minds, as they've become consumed with and don't have much time for all these corrupt activities.  These Jokers are actually the most Crooked Criminals in our Government, second only to Numero Uno, El Presidente ala Loco ...   The Top Dawg of Depraved Drudgery - The Daily Degraded Doer of Devil's Deeds... DONE..and not dirt cheap.. to our chagrin.  The letter is not a ticket to sell to illegals.

A GOOD Solid, prosperous, and successful Arms Dealer wouldn't think of sinking to this administration's level, as the fumes from Fast and Furious still toxify the air around them, by selling to illegals.  You can turn ANY prospective buyer down, just on your gut feeling alone.  No one needs the business bad enough to sink to the baseness of Obama and Holder who are willing to let thousands spill their blood of life for their agenda to remove arms from law abiding citizens, yet boost the arsenals held by  hardened drug dealers and known killers.   SCREW YOU OBAMA, YODER, HOLDER, BREWER, NEWELL, and the rest of you worthless low life, trash..  Obama, WE MADE YOU, and not one cent in your slimy pocket came from lifting a finger of work other than to lift your Executive Ordering Pen to do what your predecessors worked with others, following rules to accomplish.  You never earned a penny in your life, unless whoring homo sex is "work".

You resent the American People for their ingenuity, resolve, and undying fortitude to work how ever hard they have to to make it, to get by, or get to their goals,  YOU, are nothing but a Parasite - Hideous Hell Spawn.  Soon, you will be so FAR GONE.   And missed by none.  God Bless America.

Feds Blamed in Report on Gun Smuggling ~ USA TODAY

WASHINGTON, DC - NOVEMBER 08: U.S. Attorney G...WASHINGTON, DC - NOVEMBER 08: U.S. Attorney General Eric Holder testifies during a Senate Judiciary Committee Hearing about the controversial the 'Operation Fast and Furious' gun running program on Capitol Hill, on November 8, 2011 in Washington, DC. 'Operation Fast and Furious' was set up to be a sting set up by the federal Bureau of Alcohol, Tobacco, Firearms and Explosives that allowed weapons to be purchased from Arizona gun shops by Mexican drug cartels to trace cross boarder gun trafficking. A damning new congressional report on the government's controversial gun-smuggling investigation slams the Justice Department and continues a Republican-led assault on the Obama administration for allowing criminals to smuggle hundreds of firearms into the hands of Mexican drug cartels.
By J. Scott Applewhite, AP
Attorney General Eric Holder testifies on Capitol Hill in June regarding Operation Fast and Furious.

A draft report of "Fast and Furious: The Anatomy of a Failed Operation," released Monday by Rep. Darrell Issa, R-Calif., and Sen. Charles Grassley, R-Iowa, harshly concludes that "from the outset, the case was marred by missteps, poor judgments and an inherently reckless strategy."
The report lays out a detailed chronology of the investigation but offers no striking new revelations.
The 211-page report, based on more than 70 interviews and about 10,000 pages of documents, is the first of three planned by the House Committee on Oversight and Government Reform and the Senate Committee on the Judiciary. It comes out just one month after the GOP-controlled House held Attorney General Eric Holder in contempt of Congress for withholding Justice Department records related to the case.
Although some lawmakers have sought to portray Fast and Furious, operated by the Bureau of Alcohol, Tobacco, Firearms and Explosives as a conspiracy devised by the Obama administration to build support for gun-control legislation, the congressional report places blame instead on mistaken priorities, leadership failures and flawed communications.
The report is especially critical of William "Bill" Newell, then ATF's special agent in charge for Arizona. It paints him as an instigator of the flawed gun-walking strategy -- a boss who did not understand firearms law, lacked field experience and assisted in an attempted cover-up.
"Bill Newell had the ability and the duty to end Operation Fast and Furious much sooner than it did," says the report. "Instead, it ended as a reaction to a foreseeable tragedy. Newell authorized, endorsed, and even encouraged this investigation."
As public criticism enveloped the case, the report says Newell advised a law-enforcement colleague, "I'm not taking the fall alone. If I go down, I'm taking Dennis Burke with me."
Burke, then U.S. Attorney for Arizona, resigned amid the congressional investigation and Newell was transferred out of Arizona. Neither man could be reached for comment after an embargo on the report was lifted late Monday.
Fast and Furious was a clandestine ATF operation that lasted from late 2009 until early 2011. During that time, authorities monitored low-level criminals who bought about 2,000 guns but failed to stop trafficking of them into Mexico because they were attempting to identify and arrest cartel bosses.
The case was shut down in January 2011 -- one month after assault rifles linked to the probe were found at the scene near Nogales, Ariz., where U.S. Border Patrol Agent Brian Terry was killed in a shootout.
The report describes Fast and Furious as one of the worst scandals in bureau history: "Many people up and down the chain of command in ATF share the blame for the case's tragic failures," it says, adding that no one in the agency has been held accountable.
Among the findings:
-- Justice Department officials, from field agents to prosecutors and administrators, were predisposed to the "gun-walking" strategy in Fast and Furious because of criticism that the government too often arrested gun-trafficking "minnows" while letting the big fish get away.
-- Senior Justice Department officials failed to control the smuggling case, even after they expressed alarm at the number of weapons crossing the border unlawfully. The report says Kenneth Melson, who was acting director of ATF at the time, was derelict in his leadership, and William McMahon, ATF director of field operations, "gave false testimony to Congress" about the case.
-- Communication failures beleaguered the investigation. Gun trafficking continued for months after key officials became concerned about the gun-walking strategy and called for the operation to be shut down. "The drafting of the exit strategy was delayed," the report notes, "and the (exit) strategy itself was ultimately ignored."
The report, which says ATF agents and prosecutors in Arizona set out to make a "big case" against narcotics cartels, contains no assertion that they were promoting a political agenda to justify gun control.
Some criticism appears to reflect differences of opinion on law, rather than factual findings. For example, the authors contend that federal prosecutors in Arizona misinterpreted criminal statutes governing straw purchases, and therefore instructed agents not to arrest suspects who could have been convicted.
"ATF used flawed legal advice from the U.S. Attorney's Office as an excuse to allow the transfer of weapons to take place," the report says, adding that Arizona prosecutors were "irresponsible and negligent in delaying the indictment(s)."
The House and Senate committees plan to issue two more reports. One will focus on failures in leadership at Department of Justice headquarters; another will address "the unprecedented obstruction of the investigation" by Holder and his staff.

Fitzgerald To Step Down As U.S. Attorney

Politicians across Chicago are breathing sighs of relief with news that Patrick Fitzgerald is stepping down as U.S. Attorney for the Northern District of Illinois, effective June 30.
Fitzgerald leaves as the longest serving U.S. prosecutor in Chicago. He was appointed Sept. 1, 2001 and has been very busy since. Fitzgerald's office led successful prosecutions against former Illinois Governors George Ryan and Rod Blagojevich; former Chicago Sun-Times owner Conrad Black; several close aides to former Chicago Mayor Richard M. Daley in the Hired Truck Scandal, an investigation into powerful trucking companies who rigged a system intended to hire companies owned by minorities and women for city work; and former Chicago Police Lt. and alleged torturer Jon Burge.
Besides prosecuting Blagojevich, Fitzgerald is best known on a national level for his appointment as special counsel and his prosecution and conviction of former Vice President Dick Cheney aide Scooter Libby for his involvement with the Valerie Plame affair, where the late columnist Robert Novak revealed Plame to be a covert CIA operative in 2003. Libby was convicted on four of five counts of perjury and obstruction of justice.
Fitzgerald said in a statement to media:
“When I was selected for this position in 2001, I said that it was one of the greatest opportunities that one could ever hope for, and I believe that even more now after having the privilege of working alongside hundreds of dedicated prosecutors and agents. I have tried not to get in their way. I extend my deepest appreciation to the attorneys and staff for their determined commitment to public service. This was a great office when I arrived, and I have no doubt that it will continue to be a great office.”

(3) Fire Eric Holder

THANK YOU SARAH PALIN FOR SPEAKING FOR AMERICANS.. Unlike the traitor in chief who "speaks" for the people without a clue as to what we'd say.
He hasn't gotten any of it right so far, and after three years, he's had more than enough time to find out what We, The People would say. Sarah Palin rocks, and she
Understands the American People. Not only does Mr. Obama not understand us, he misspeaks for us repeatedly, and we're beyond sick and tired of him making us sick and tired. Go away. Fire Holder or Resign in a two for one deal.. Two turkeys with one arrow, skewered and banned from the United Sates government, not even to clean the bathroom floors.

Fire Eric Holder

by Sarah Palin on Thursday, November 10, 2011 at 2:14pm
It’s tempting to get distracted with the horse race aspect of electoral politics during a primary season. But as pundits talk about “who’s up and who’s down” in the 24 hour news cycle, we must keep our eye on the ball with the Obama administration. They rely on distraction to skirt responsibility, but we’re going to hold them accountable for their corruption and incompetence.
When the stories about Operation Fast and Furious first broke, it sounded too crazy even for this administration.
Why would any government official with an ounce of common sense think it’s a good idea to facilitate the smuggling of thousands of guns into the hands of violent Mexican drug cartels? That’s what Operation Fast and Furious did.
You might think Eric Holder’s Department of Justice was setting up a sting operation in which our federal agents would swoop down and arrest the bad guys the minute the guns traded hands. But that’s not what happened. Eric Holder’s DOJ had American gun dealers sell weapons to “straw purchasers” tied to drug cartels without actually following the movement of the guns as they were then sold to Mexican drug lords. They apparently thought this so-called “gun-walking” operation would help them chart the path of gun smuggling, but they didn’t have a plan to actually control the weapons’ movements as the guns were allowed to “walk” into Mexico. All Holder’s DOJ did was arm violent criminals. What manner of fools do we have working in this administration? What’s next? Supplying nuclear weapons components to the Iranians so we can track their activities?
Fast and Furious isn’t just your typical government incompetence. This is a deadly tragedy. U.S. border agent Brian Terry was gunned down with weapons connected to Holder’s debacle. At least 200 Mexican citizens were also killed by criminals using Fast and Furious weapons. We can only imagine how many more people will be murdered by criminals our government armed.
When an agent with the Bureau of Alcohol, Tobacco, Firearms and Explosives blew the whistle on this operation, the DOJ leaked sensitive information about him to the press. This week, the former U.S. Attorney for Arizona, who was ousted in the wake of the scandal, admitted to being the leaker.
And where is President Obama’s Attorney General Eric Holder in all of this? When did he first know about the operation? In his testimony to the House Oversight Committee on May 3, 2011, Holder stated, “I probably heard about Fast and Furious for the first time over the last few weeks.” But the DOJ’s own documents prove that Holder had been receiving briefings on Fast and Furious for nearly a year before that date. In other words, our government’s top law enforcement official, Eric Holder, lied to the American public. He finally admitted this week to the Senate Judiciary Committee, “In my testimony before the House committee [on May 3], I did say a few weeks. I probably could have said a couple of months. What I said about a few weeks was inaccurate based on what happened.”
When the nation’s highest law enforcement official lies to the American people, he must go.
And if he claims that he didn’t lie, then how else do we explain this situation? He’s either lying or he’s so grossly incompetent and lazy that he didn’t read important life and death briefings from his deputy attorney general and didn’t know about this deadly operation run by people under him. So, which is it? Incompetent, lazy, or lying? No matter which explanation fits, he needs to go.
Holder conceded this week, “I have ultimate responsibility for what happens in the department.” He can prove it by resigning. And if he refuses to resign, then President Obama – with whom the bucks ultimately stop – can prove that he respects honesty, transparency, and accountability in his administration by firing Holder.
I stand with the members of Congress who are calling for Holder’s resignation. I stand with the family members of Brian Terry who are demanding transparency and accountability. Mr. President, where do you stand?
- Sarah Palin
P.S. It can be argued that some elements of this scandal give the appearance of perhaps being intended to be used to infringe on our Second Amendment rights. I invite our President to correct concerned Americans if they’re wrong on this.

Justice Dept. proposes lying, hiding existence of records under new FOIA rule

A proposed revision to Freedom of Information Act rules would allow federal agencies to lie to citizens and reporters seeking certain records, telling them the records don’t exist.
The Justice Department has proposed the change as part of a large revision of FOIA rules for federal agencies. Specifically, the rule would direct government agencies who are denying a request under an established FOIA exemption to “respond to the request as if the excluded records did not exist,” rather than citing the relevant exemption.
The proposed rule has alarmed government transparency advocates across the political spectrum, who’ve called it “Orwellian” and say it will “twist” public access to government.
The draft FOIA revisions were first published in March, but the Justice Department re-opened comment submissions in September after several open-government groups raised objections. A Justice Department spokesperson said the agency is committed to public input and transparency, which is why it re-opened public comments on the rule — an unusual step in the process.
In a public comment regarding the rule change, the ACLU, along with Citizens for Responsibility and Ethics in Washington (CREW) and OpenTheGovernment.org, said the move “will dramatically undermine government integrity by allowing a law designed to provide public access to government information to be twisted to permit federal law enforcement agencies to actively lie to the American people.”
Anne Weismann, the chief counsel of CREW, said the Justice Department has a legitimate purpose behind the rules: to protect sensitive information about ongoing investigations. However, she said lying about the records “is an overbroad and improper response.”
“The problem is, if you’re a FOIA requester and the agency says they don’t have the records, you have no reason to doubt that,” Weismann said. “But if they cite an exemption, you have the option to sue.”
Those groups have suggested an alternate federal response that would not require any revisions to the rules. “We interpret all or part of your request as a request for records which, if they exist, would not be subject to the disclosure requirements of FOIA pursuant to section 552(c), and we therefore will not process that portion of your request.”
Conservative government watchdog Judicial Watch has also lambasted the proposed rules change. (RELATED: Obama admin. pulls references to Islam from terror training materials, official says)
The news is “not surprising, coming from the Obama administration,” said Christopher J. Farrell, director of investigations and research at Judicial Watch.

The Obama administration is already doing it right now by actively misleading the public concerning White House visitor logs,” Farrell said. “Every day, the Obama administration misrepresents and conceals the true, complete record of who is going in and out of the White House — all the while proclaiming themselves champions of transparency. It’s truly Orwellian. The proposed rule change should be rejected.”
However, the Justice Department says it has long had this standing authority. A 1987 memo from then-Attorney General Edwin Meese III advises the Justice Department that it has the legal authority to deny existence of records, using the same language as the new rule.
“Where an exclusion is employed, the agency is legally empowered to ‘treat’ the excluded records as not subject to the FOIA at all,” Meese wrote. “Accordingly, a requester can properly be advised in such a situation that “there exist no records responsive to your FOIA request.” Such phrasing — as opposed to any more detailed statement that, for example, any records specified in a particular request ‘could not be located’ — most rationally and fairly implements an exclusion’s effect.”
If the new rule were to go into effect, there is a good chance it might be challenged in court. Courts have traditionally given the Justice Department fairly broad powers regarding records disclosure, but recent precedent may give the DOJ trouble.
In a case involving the FBI and records disclosure, U.S. District Judge Cormac Carney wrote that the “Government cannot, under any circumstance, affirmatively mislead the Court.”
Under current FOIA practice, the government may withhold information and issue a denial saying it can neither confirm nor deny the existence of records. Such a denial is known as a “Glomar response” — named after the legal battle between the Los Angeles Times and the CIA in the 1970s over records concerning the CIA’s attempts to salvage a sunken Soviet submarine.
Upon taking office, President Obama released a memorandum declaring his administration was “committed to operating with an unprecedented level of openness. Specifically, he pledged to bolster the strength of the FOIA act, calling it “the most prominent expression of a profound national commitment to ensuring an open government.”
